How We Got Here

New York’s path to legalization was long and incremental. Here is the timeline of key milestones that shaped the current legal landscape.

2014

Compassionate Care Act signed, creating New York's medical cannabis program with limited conditions and forms.

2019

Cannabis decriminalized. Possession of less than 2 ounces reclassified as a violation, not a crime.

2021

Marijuana Regulation and Taxation Act (MRTA) signed March 31, legalizing adult-use cannabis for ages 21+.

2022

Office of Cannabis Management (OCM) established. First CAURD licenses issued prioritizing social equity.

2023

Legal dispensary sales begin in New York. Licensed retail locations open across the state.

2024

Expanded licensing. More dispensaries open including in Staten Island. Home cultivation rules take effect.

Age Requirements

21 and Over Only

You must be 21 years of age or older to purchase, possess, or consume cannabis in New York State. This applies to all cannabis products including flower, edibles, concentrates, tinctures, and topicals.

A valid government-issued photo ID is required at every dispensary visit. Acceptable forms include a state driver’s license, non-driver ID, passport, or military ID. Expired IDs are not accepted.

Possession Limits

How Much Can You Carry

New York law allows adults 21 and over to possess up to 3 ounces of cannabis flower and up to 24 grams of concentrated cannabis (including vape cartridges, wax, shatter, and other extracts) at any time.

At home, you may store up to 5 pounds of cannabis. This higher limit accounts for home cultivation harvests and personal stockpiling of legally purchased products.

Consumption Rules

Where You Can and Cannot Consume

Permitted Locations

  • Private residences (your own home or apartment, subject to landlord policies)
  • Outdoors in areas where tobacco smoking is permitted
  • Designated cannabis consumption lounges (as they become licensed)
  • Private property with the owner's permission

Prohibited Locations

  • Inside any motor vehicle, whether parked or moving
  • On school grounds or within school property
  • In workplaces, unless employer specifically permits it
  • On federal property (post offices, courthouses, national parks)
  • In public housing operated with federal funding
  • In enclosed public spaces where smoking is prohibited
  • Near the entrance of buildings where smoking is restricted

Landlord and property rules still apply

Even though cannabis is legal, private property owners and landlords can prohibit its use on their premises. Check your lease or building rules. Smoking bans in multi-unit buildings may include cannabis.

Home Cultivation

Growing at Home

New York allows adults 21 and older to grow cannabis at home for personal use. The limits are 3 mature plants and 3 immature plants per person, with a household maximum of 12 total plants regardless of how many adults live there.

Plants must be grown in a secure area not visible to the public. You cannot sell home-grown cannabis. Seeds and clones can be purchased from licensed dispensaries or gifted between adults.

Driving Under the Influence

Cannabis and Driving

Driving under the influence of cannabis is illegal in New York, just as it is with alcohol. There is no legal threshold or per se limit for THC in blood, meaning officers use behavioral observation and field sobriety tests to determine impairment.

A DWAI (Driving While Ability Impaired) charge for cannabis carries penalties including fines, license suspension, and possible jail time. Penalties increase for repeat offenses.

Open containers of cannabis in a vehicle are treated similarly to open alcohol containers. Keep all cannabis products in sealed, unopened packaging in the trunk or a locked area.

Cannabis impairs reaction time, coordination, and judgment. Plan ahead. Use rideshare, public transit, or have a designated driver.

Employment

Workplace Protections

New York law prohibits most employers from testing for cannabis or discriminating against employees for lawful off-duty cannabis use. There are exceptions for safety-sensitive positions, federal contractors, and roles where impairment creates a direct safety risk.

Employers can still prohibit use during work hours and on work premises. They can take action if an employee is impaired on the job. The law protects off-duty, off-premises use, not impairment at work.

Where to Buy Legally

Cannabis can only be legally purchased from licensed dispensaries. Unlicensed sellers, pop-up shops, and social media dealers are operating illegally. Their products are untested and potentially unsafe.

Legal dispensaries like Studio 57 carry only lab-tested products from licensed cultivators and processors. Every product has batch-specific test results for potency and contaminants. When in doubt, ask to see the certificate of analysis (COA).

Travel

Traveling with Cannabis

You may travel with legal amounts of cannabis within New York State. However, crossing state lines with cannabis is a federal offense, even if both states have legalized it. This applies to driving, flying, taking a train, or any other mode of transportation.

Airports are federal jurisdiction. TSA follows federal law. Do not attempt to fly with cannabis products. If traveling by car to New Jersey or Connecticut, leave your cannabis at home.
